Liquidated Damages for Violations of ISF Importer Rules to Begin March 15

CBP will begin issuing liquidated damages claims for violations of a new rule on March 15. The new rule expands the definition of the importer security filing for certain types of shipments. The enforcement was delayed to March 15 due to the recent federal government shutdown.

The ISF must be transmitted to CBP no later than 24 hours before the cargo is loaded in a vessel destined to the United States, or any time before loading for foreign cargo remaining on board.

The rule expanded the definition of ISF importer, placing responsibility for filing with the party that causes the goods to enter the limits of a port in the United States. The rule shifts the legal responsibility for filling the ISF, but not necessarily who actually submits the data.
